In 1999, the FTC and multiple states sued Equinox. Regulators proved that the company operated as an illegal pyramid scheme, as distributors made their money by recruiting new sellers rather than selling actual water filters and vitamins to retail customers.
The company was also charged with misleading potential recruits, often running classified ads that implied a traditional salaried position rather than independent commission-based sales.
In April 2000, Equinox agreed to settle the case, was ordered dissolved, and was penalized nearly $40 million in restitution for victims
Founder William Gouldd was forced to surrender significant assets and was permanently banned from participating in any multi-level marketing programs.
