Gas Up USA is no longer active. The company’s prepaid fuel-card membership and independent-representative program collapsed after its bank froze company accounts in December 2002, interrupting operations for nearly three months.

Gas Up USA was founded by Eric J. Dalius and operated as a membership-based network-marketing company during the early 2000s. Members purchased access to the company's Universal Bonus Gas program, which promoted discounts of up to 21% on gasoline. The membership also included discounts or benefits involving prescription drugs, hospitals, physicians, dental care, vision services, chiropractic care, roadside towing and legal assistance. Historical company materials priced enrollment at $149.99, with no additional charge to participate as an Independent Representative.

Independent Representatives sold memberships and could earn commissions and fuel bonuses from their referrals and sales organizations. The company reportedly grew rapidly before Patriot Bank froze accounts containing customer funds on December 23, 2002. A court later ordered the release of more than $1 million, allowing Gas Up USA to resume processing delayed transactions in March 2003, but the company stated that it never recovered from the resulting loss of consumer confidence.

Pennsylvania authorities filed proceedings involving Gas Up USA and Dalius after consumers complained about delayed or unfulfilled transactions. In April 2004, the parties entered an agreement terminating the proceedings in favor of Gas Up USA and Dalius after an investigation concluded that the reported consumer harm resulted from Patriot Bank's freezing of the accounts rather than misconduct by the company. Gas Up USA and Dalius agreed to reimburse Pennsylvania $20,000 in investigative costs and received the right to seek recovery of that amount from the bank and its president.

District Attorney Nola Tedesco Foulston confirms the Consumer Fraud and Economic Crime Division of this office is working in conjunction with Kansas Attorney General Carla Stovall is investigating a program known as "GasUpUSA." The GasUpUSA program claims to provide consumers with the opportunity to purchase prepaid gas bonus cards at a discount price and that these cards can be used at a majority of gasoline outlets across the United States. According to information provided by GasUpUSA, the program also provides several other benefits such as discounts at hospitals, pharmacies and other businesses. Individuals can enroll as a "Member" and any additional fee is waived if the person wants to be a "Independent Representative" for a total price of $149.99. According to the company's materials, an "Independent Representative" participates in the opportunity to earn and receive commissions and certain free gas bonuses from the sale of memberships.
